Terms and conditions

Scope

These terms apply to SwissB2B services provided by Swiss Portal Solutions GmbH to business customers.

Service

SwissB2B researches company addresses and B2B data to order from publicly accessible sources. Delivery is usually provided as CSV or Excel.

Contract formation

A contract is formed when SwissB2B confirms the order or begins performance. The agreed criteria and volume define the scope of the service.

Prices and payment

Payment is made in advance through the provided payment methods or by invoice if agreed. Prices are stated in CHF and applicable taxes are shown during checkout.

Delivery

Delivery depends on the selected package: two working days for Firmendaten, three for Firmendaten PLUS and four for Firmendaten PRO. Electronic delivery constitutes fulfilment.

Quality and complaints

We verify email addresses and replace demonstrably incorrect contact data free of charge when reported within 30 calendar days of delivery. We cannot guarantee absolute completeness or error-free data.

Data use

The customer receives a non-exclusive, time-unlimited right to use the delivered data for its own B2B activities. The customer remains responsible for compliant use under applicable data protection, outreach and competition rules.

Customer duties

The customer must define lawful criteria, assess the intended use and comply with applicable data protection, outreach and competition rules.

Liability

SwissB2B is liable for direct damage caused intentionally or through gross negligence. To the extent permitted by law, liability for indirect damage, lost profits or campaign outcomes is excluded.

Force majeure

Neither party is responsible for delay caused by an unforeseeable event outside its reasonable control. Performance resumes when the impediment ends.

Final provisions

Swiss law applies and the place of jurisdiction is Appenzell, Switzerland. If one provision is invalid, the remaining provisions continue to apply.
